Georgia just passed a law that ban abortion after a heartbeat is detected. It purports that unborn children should enjoy the privileges of the 14th Amendment.

So let's talk about how Georgia treats unborn children in its jails and prisons. /1
Georgia jails or imprisons tens of thousands of unborn children.

Those unborn children are not provided a lawyer.

They are not entitled to a reasonable bond.

They are held without being suspected of a crime.

Unborn children are seized when their mothers are. Without reasonable articulable suspicion of a crime.

Injuries inflicted on a mother in jail are inflicted on the child. Without probable cause to hold that child. /3
According to a recent study, six percent of women in custody miscarry.

None of those unborn children were provided with any of the process we would expect before their execution. /4
Because these children, who have committed no crime, are denied adequate medical care and nutrition, they will likely suffer life-long consequences from incarceration without due process.

In Georgia, it is a serious felony to inflict suffering on a child. And many police officers, correctional officers, and prosecutors who fail to provide adequate care or nutrition should face consequences for those choices. /6
And of course, Georgia should also agree to abandon any claims, under a theory of qualified immunity, that the rights and privileges of the unborn have not been clearly established. /7
But none of that is happening. These unborn children aren't actually being given a right to due process. Or a right to be free from unreasonable seizures.

Georgia can't even agree to stop shackling mothers giving birth.

So spare me your soaring rhetoric about the value of a human life. Georgia treats the incarcerated unborn with unimaginable cruelty. And it will continue to do so.

Because Georgia lawmakers do not believe that incarcerated children's lives have value. /f
