I agree. And note that the PM could “comply” by simply sending a formal letter that is designed to be as unpersuasive as possible.
Eg “I am required by the [ ] Act 2019 to seek an extension of the A50 period until [ ]. I hereby do so.”
And if the EU said “Only if you agree to A”, the unwilling PM just says “I won’t agree to A.”
If you want a PM who will bat hard for an extension, if necessary making concessions to get it, you need a PM who actually wants one.
Given the timing, that means (a) finding another PM (call them X) backed by a HoC majority (b) passing a no confidence motion in the May Government.
(The reason for (a) is that, if (a) is satisfied, the consequence of (b) is that May has to resign at once, advising the Queen to send for X. Absent (a) May stays on as PM until a general election.)
