NEW: The 6th Circuit, in a 2-1 decision, upheld a Kentucky law requiring doctors to perform an ultrasound and show/describe the images to the woman before performing an abortion, finding the law doesn't violate the First Amendment opn.ca6.uscourts.gov/opinions.pdf/1…
Judge Bush, writing for the majority: "As a First Amendment matter, there is nothing suspect with a State’s requiring a doctor, before performing an abortion, to make truthful, non misleading factual disclosures..."
A district court judge had issued an injunction blocking the law, today's 6th Circuit opinion reverses that decision
Judge Donald dissented, and she brings fire: "The Commonwealth has coopted physicians’ examining tables, their probing instruments, and their voices in order to espouse a political message, without regard to the health of the patient or the judgment of the physician"
More from Donald's dissent: "H.B. 2 is a restriction on speech that has no basis in the practice of medicine. It should be subjected to heightened scrutiny and deemed unconstitutional, lest our constitution dissolve, and tyranny be erected on its ruins. I dissent!"
