In NY 2nd Am case, several groups that traditionally file briefs in support of gun control regulations have filed briefs in support of neither side, urging SCOTUS not to adopt strict scrutiny. In other words, kill the NY law but don't adopt strict scrutiny

2/ Nevada v. Hall (1979) found that the text and history of the Constitution "do not answer the question whether the Constitution places any limit on the exercise of one's State's power to authorize its courts to assert jurisdiction over another State."
3/ FTB v. Hyatt (2019) found that Hall found that "the Eleventh Amendment, and our sovereign-immunity precedents did not bear on the question because they "concerned questions of federal-court jurisdiction.'"

1/ Thread on Murphy v. Collier (Texas Buddhist execution case). The Court granted the stay on March 28. #SCOTUS
2/ At the time, J. Kavanaugh wrote a two-page concurrence to explain why he voted to stay the execution. J. Thomas and Gorsuch would have denied the stay, but did not explain their reasons.
3/ Monday yielded more developments in this month-old case. It is strange for a Justice to write a dissent to explain their decision a month earlier. It is even stranger for a Justice to respond to these late additions. Yet, this is precisely what happened.

New: DC and MD have dismissed their claims against Trump in his *individual* capacity in the emoluments clause case. They're still proceeding against him in his *official* capacity as president, though, so the case is very much still on assets.documentcloud.org/documents/5638…
Why does this matter? The rulings so far allowing the case to go forward have involved the official capacity claims (DOJ recently appealed to the 4th Circuit) — the judge hasn't ruled yet on the individual capacity claims. This dismissal means the case won't proceed on two tracks
Trump's lawyers repping him in his individual capacity recently asked the judge to put the case on hold while they pursued an appeal, since the judge had said discovery could go forward. DC/MD filed papers tonight saying that's now all moot assets.documentcloud.org/documents/5638…

1. what they describe is almost the worst thing a presidency could do

Two ground rules for understanding all this.

Rule 1: THERE IS NO DEFINITION OF GENDER IN UNITED STATES LAW. There is no one database everyone reads your gender from. Every part of the federal government, every state, every corporation has their own notion of "your gender".
This is normally very bad for trans people, because it means "fixing" one part of the federal government or one part of one state doesn't fix anything else. In this case it helps us, because *breaking* one thing doesn't *necessarily* break anything else.
