BREAKING: Justict Department has indicted Wikileaks founder Julian Assange on 18 counts related to obtaining trove of classified information from Chelsea Manning. 1/x
Charges in superseding included conspiring with Manning to obtain the classified information.
Justice Department officials took pains at briefing to say Assange was not acting as a journalist.
John Demers, top Justice national security official, said dept doesn’t target reporters and “Assange is no journalist.”
Indictment alleges Assange starting in 2009 actively solicited classified info, and Manning responded to those entreaties by using her access as an intel analyst to search for and retrieve classified docs.
Manning and Assange engaged “in real time” comms regarding her transmission of docs to Assange, DOJ alleges.
Will be interesting to see how press advocates react to this latest indictment. Initial charges against Assange were made public in April: latimes.com/world/la-fg-br…

The FBI has noticed a significant increase since the fall in investigations of racially-motivated domestic terrorism suspects, a senior FBI country-terrorism official said today.
The FBI did not provide a statistical breakdown of the investigations during a terrorism briefing with reporters. But the FBI official said the bureau had about 850 open domestic terrorism investigations.
Those 850 cases include a wide-variety or investigations, ranging from racially motivated suspects (including those targeting religions) to those motivated by their anti-government, abortion and animal rights beliefs.

FMR Acting AG Matthew Whitaker has NOT left the building. He is serving as a senior counselor in the office of Associate AG. There is no associate AG or acting associate AG. Principal Deputy Associate AG Jesse Panuccio remains in his post. He had served as acting associate AG.
Panuccio's term as acting associate AG ran out after 210 days as prescribed by the Vacancies Reform Act. He had taken over from Rachel Brand, who abruptly quit to take a job at Walmart almost exactly a year ago. No word on a nominee for that slot.

BREAKING. senior DOJ official: Whitaker has not recused from Mueller probe. After extensive review by senior officials, he did not seek formal ruling from ethics office. BUT a senior doj ethics official said it was a "close call" and he should recuse in an "abundance of caution."
In cases involving an appearance of conflict of interest -- versus a real conflict, like having once represented a defendant -- it is incumbent upon the official to seek an ethics recommendation.
Because this was a "close call," senior appointed DOJ officials recommended to whitaker he not recuse. They noted no AG has ever recused for an "appearance" issue in the past. Whitaker yesterday accepted that recommendation.

Chelsea Manning is found in civil contempt by judge for second time. That means judge denied motion to quash grand jury subpoena to testify. She maintains nothing will convince her to testify before grand jury into WikiLeaks so she will likely be in jail for several months.
Additional financial penalty exists this time around for Chelsea Manning. First, she will be fined $500/day after 30 days in jail. Then after 60 days in jail she will be fined $1000/day. This is an escalation of punishment to force compliance.
The government knows Chelsea Manning has a spirit strong enough to endure several months in jail. They believe they can break her by sapping her of whatever funds she has for her legal defense and in her personal bank account.

.@rcfp Just lost the case to unseal details on the alleged prosecution of #WikiLeaks founder Julian #Assange.
The judge acknowledged that it's an important issue, but nevertheless concluded that the statutes and case law don't provide a groundwork for the @RCFP's application (which cleverly seized on a novel set of circumstances).

Dismissed without prejudice, so it may not be over yet.
@rcfp The crux of the government's argument appears to have been "sometimes a mistake is just a mistake, you can't infer anything more from it."

In July 2016, Cambridge Analytica's CEO offered to help Julian Assange organize the hacked DNC/Podesta emails that WikiLeaks was releasing to make them more accessible/searchable for users.
