DOJ is asking the committee to delay the contempt vote until the president makes a decision about whether to invoke executive privilege (the vote is scheduled for tomorrow)
Besides the document issue, DOJ has also said that a senior official John Gore, will not appear for a deposition if he can't bring a DOJ lawyer with him. The committee has said that not allowing agency counsel in the room is consistent with longstanding practice
As part of today's letter to the committee, DOJ attached a May 23 opinion from the Office of Legal Counsel concluding Congress can't prohibit agency officials from bringing agency counsel if they're going to be asked about potentially privileged info assets.documentcloud.org/documents/6150…
