@CharlesOrtel A noteworthy press release from the DOJ yesterday:
justice.gov/opa/pr/walmart…
Hmm, FCPA -- the Foreign Corrupt Practices Act falls under the DOJ's Fraud Section:
justice.gov/criminal-fraud…
"unlawful... to make payments to foreign government officials to assist in obtaining or retaining business. Specifically, the anti-bribery provisions of the FCPA prohibit the willful use of the mails or any means of instrumentality of interstate commerce corruptly"
FCPA also requires companies w/securities listed in the US to meet its accounting provisions (15 U.S.C. § 78) More in this helpful Baker Hostetler publication: bakerlaw.com/files/Uploads/…
Very interesting language in the FCPA regarding its coverage of nonprofits and multiple other entities. Of note is the definition for "domestic concern" in this article: fcpaprofessor.com/non-profits-an…
Am not an att'y, but it seems to imply that it would cover, for example, an illegally-created nonprofit such as some of the Clintons' interminable maze of money passthroughs... #ClintonFoundation #ClintonCrimeFamily
... because they have a long-established pattern and practice of utter disregard for meeting any conceivable kind of accounting provisions 🙄
More on the DOJ Fraud Section ⚖️ All the best to them for their fine work 👍 @TheJusticeDept
