Census question:
Many people rightly note that Roberts validated Muslim Ban 3.0, so why not Census 2.0?:
But Trump officials changed the Muslim Ban twice into a less blatant version. Enough of a fig leaf for Roberts.
Census 2.0 has to be the same question. No fig leaf, right?
2/ I doubt Roberts is in a rush to look like a fool upholding the same census question when he could just let a trial run out the clock. I think you'd need Roberts, not Cert Rule of 4, to expedite. No? @JoshuaMatz8 @marty_lederman @CBHessick @dorfonlaw @Jennifer_Nou @stevenmazie
3/ In Muslim Ban, the courts forced a change the actual policy - twice - as a facade distancing impermissible anti-Muslim animus.
Hard to image new census language that distances from the underlying lies sufficiently for Roberts to be eager.

House W&M finally sues for Trump tax returns.
The complaint should have stated the sincere reason for the request (high crimes and misdemeanors), not a pretext (oversight of audit process), even if pretext is otherwise legitimate.
After Census decision, this is a big error... 1/
2/ In Census case, there was an impermissible arbitrary/political/racial motive and a pretextual motive. SCOTUS rejected the pretext and the citizenship question (for now).
In House tax case, there are 2 real motives (high crimes and politics) and pretexts (e.g., audit process).
3/ US v. Nixon, the most important precedent on subpoenas, requires "good faith," to avoid fishing expeditions. If the official's motive is partly political, that's permissible as long as the official also gives the sincere, good faith legitimate reason. But Ways & Means failed.

Bottom line: @KamalaHarris dominated the entire night and did something no one else did: She made @JoeBiden look old, out of touch, obsolete. Probably a turning point. No one else and nothing else tonight was remotely as consequential.
For months, I've been trying to remind myself why @JoeBiden was such a failure in his 1988 and 2008 campaigns.
Tonight, Biden reminded everyone. A disaster. If you watched his post-debate interview, he was incoherent. And I had been shifting toward Biden before last week.
Biden post-debate, incoherent:
"Did Harris mischaracterize?"
"Yes... We're talking about whether Dept of Ed, as opposed to courts, ordering de jure [de]segregation...There is de facto & de jure segregation. I supported the courts ability to strike down, to order busing..."
