McFadden has previously ruled for the administration in another high-profile fight with Democrats, when he decided that lawmakers did not have the legal standing to sue to prevent Trump from reassigning money appropriated by Congress to build a wall along the border with Mexico.
In the dispute over border funding, McFadden wrote last month: “While the Constitution bestows upon Members of the House many powers, it does not grant them standing to hale the Executive Branch into court claiming a dilution of Congress’s legislative authority.”

U.S. District Court Judge Trevor McFadden, who sits on the bench in Washington, D.C., made two donations to Trump’s presidential campaign totaling $1000 in October 2016 – both coming within three weeks of Election Day, documents filed with the Federal Election Commission show.
Before Trump nominated McFadden for a federal judgeship ➡️ selected McFadden to serve as his Acting Principal Deputy Asst AG at the Department of Justice. McFadden remained at the Justice Department until the Senate confirmed his nomination to the bench last October.
