Holy hell, this guy just won’t stop!
No, Merrick Garland should not be nominated to the Supreme Court by Democrats in 2021. Absolutely not. What was, in effect, a compromise pick by Obama in 2016 is a political and judicial lifetime away from the nominees of the next administration, should a Democrat defeat Trump.
Garland will be turning 70 during the next presidential term. It is basically unthinkable to me that a Democratic president in 2021 would do such a thing, and I can’t believe I’m needing to actually write words about this!

Interesting to see a justice change the qualifier that X "may" have the *effect* of Y into a claim that the prior case asserted that X "often" is done for the *purpose* of Y. 👀

Since I didn’t get to it today, here’s my issue: An area of Justice Thomas’s dissent in Flowers, about the potential media impact on the case. In that paragraph, Thomas misstates a reference to an earlier case — and then uses that misuse to the opposite end of the original case.
