Broken record: The #2020Census and many other crucial cases may pass through Second Circuit, which has two vacancies which, when filled, will “flip” the circuit. It’s a great disservice to @realDonaldTrump not to have nominees already before the Senate for these vacancies.
Similarly, the Ninth Circuit has 2 vacancies for which no nominees have been put forward. While the circuit is far from “flipping,” every new judge confirmed increases chances of a reasonable panel and 11-judge en banc panel. As with 2d Circuit, @realDonaldTrump needs nominees. 2
The logjam or preventing nominees for these two crucial circuits has many excuses none of which should stop @realDonaldTrump from demanding nominees this week. He should stress need for women nominees as his 44 Circuit judges to date are 3:1 male/female in a 50/50 Bar. 3
As @realDonaldTrump can expect @KamalaHarris as a nominee this gender imbalance will detract from one of @POTUS great first term accomplishments: restoration of constitutionalism in federal courts. 4
But @realDonaldTrump needs to get WH Counsel, AG, and @senjudiciary Chair @LindseyGrahamSC and @senatemajldr together and make a plant to nominate, hold hearings and votes on these four vacancies ASAP. Not in the fall. Too much at stake. 5
