So @DominionEnergy has decided that it should be the arbiter of who gets to compete against it to serve renewables to Virginians.
The state's law provides that if a utility doesn't have a regulator-approved "green tariff" (and Dominion does not) that a customer may buy a "100% renewable" product from a competitive retailer instead.
This is the only, narrow opening in Virginia today for a customer to take energy supply from a company other than Dominion -- or at least it was until last week, when Dominion unilaterally decided it would stop letting its customers do what is their right under law
Dominion's argument is that "100% renewable" must mean that there is a renewable *capacity* resource available at sufficient quantities when the customer is using energy to back it up.
Interesting interpretation, which has the notable defect of being found nowhere in the statute, administrative regulation, or the tariff in question.
Dominion is beautifully shameless on this count. The green product it *does* offer appears to work in exactly the same manner which they object to their competitor's working. dominionenergy.com/home-and-small…
There's actually an interesting policy argument about whether customers who want to call themselves "100% green energy" should have to show green "capacity."
But as its would-be competitor @DirectEnergy observes, Dominion doesn't hold themselves to that standard and its tactic for obstruction is clearly self-interested
Virginia's State Corporation Commission has seemingly agreed to make this a rocket docket. Dominion gets a reply by July 31, Direct by Aug 6, and then a ruling. It's docket number is PUR-2019-00117
