/ @USCIS changes citizenship policies. Side question: I was born to a US citizen mom and a naturalized, US citizen Navy father, but born abroad, and not at a military base or hospital. Q: Could I theoretically be president?
@USCISCuccinelli @sivavaid @neal_katyal
/ @USCIS says change doesn't deny citizenship to children military born abroad. It only involves children born outside the US, and who are not US citizens. It doesn't invoke birthright citizenship because not related to US births.
/ My citizenship, as I understand it, is not constitutional birthright citizenship. It is a creation of federal statute. That means it could be taken away (for future similarly situated babies). I don't think citizenship can be denied retroactively, though.
/ As I've always understood it, my citizenship comes from two independent sources: (a) born to US service member; (b) 2 US Citizen parents (but must have lived in the US for [Mom-1yr, Dad-5yrs]). So, not sure new policy wldve affected my citizenship @SpoxUSCIS
/ This policy change affects far fewer people than if the Administration simply decided to end Birthright Citizenship. IF Prez thinks BC is not constitutional, in theory he could end it with an executive order, I believe.
/ Courts would hash it out, but some academics believe birthright citizenship was limited to a narrow fix of children of slaves, and not automatic citizenship for children of foreign nationals.
/ The takeaway is that this is really complicated stuff, even for someone (me) who has a personal interest in understanding from whence his citizenship came.
