Manafort's lawyers are right.
@cyvance made a clear double jeopardy error and has dodged answering for it...
But what about valid state tax fraud charges?

#Emoluments: @AndyGrewal and I have opposing views on the clauses, but I agree with his bottom line: It is odd that the 2d Cir found that the plaintiffs’ claims fall within the “zone of interests” of the clauses - without ruling on the meaning or purposes of the clauses.
@AndyGrewal 2/ It turns out that @gauthamrao & I have written an article addressing the "zone of interest" question, explaining the history of the clauses in the context of British taxation, colonial monopolistic policy, & unfair competition when govts play favorites.

@AndyGrewal @gauthamrao 3/ There is a valid question as to how the "zone of interest" test applies to these constitutional clauses.
But if a court decides that a plaintiff's claim is within that zone, surely it would have to address the meaning of the word "emolument" & original purpose of the clauses.

The new charges against Paul Manafort are different-but-related to those in the initial federal indictment against him — charges to which he pleaded guilty.

Manafort's guilty plea will now be admissible in the New York case.

The Manhattan District Attorney's office was quite strategic in filing the new charges against Paul Manafort. They're specifically designed to avoid double jeopardy claims, and since they're state crimes, Trump's pardon power is useless.

If he's convicted in the New York case, #Manafort could face up to 25 years behind bars in the state's "notoriously tough prisons.”

NEW - robert mueller has asked a federal judge for more time to decide whether or not to retry paul manafort in alexandria, VA, where the jury could not reach a unanimous decision on 10 of the 18 bank & tax fraud charges he faced, resulting in a mistrial.
this, could take a while. why?

federal prosecutors don't want to make a decision to retry (or not) until after the court rules on whatever post-trial motions paul manafort's lawyers may file
and keep in mind that manafort’s defense is currently buckling down in preparation for the start of his washington trial; jury selection is sept. 17, and opening arguments are slated for sept. 24

Judge Ellis has declared a mistrial in 10 of the counts against #ManafortTrial and has read that Manafort is guilty on eight of the counts.
#PaulManafort could be sentenced to 30 or more years in jail for each of the eight convictions.

Manafort is 68yrs old.

This will be a life sentence.
#Manafort is guilty of
▪5 tax fraud charges
▪2 counts of bank fraud
▪1 charge of hiding foreign bank counts

The bank fraud charges carry the stiffest sentences.
