With the news from India that former Ranbaxy CEO Malvinder Singh and his brother Shivinder have been arrested for alleged fraud, I want to offer a few thoughts from my decade of reporting #BottleofLies. (1)
Malvinder Singh was complicit in Ranbaxy's ongoing fraud. He was at the Oct. 14, 2004 boardroom meeting when @D_S_Thakur's explosive PPT (1 page below) alleging global data falsification, was shown to board members. (2)
Ranbaxy's top officials embarked on a cover-up, ordering destruction of PPT + laptop. Company secretary was sent from room and meeting minutes were later forged. The buried PPT (known as Self Assessment Report or SAR) became Ranbaxy's Kryptonite. (3)
In 2008, in secret talks, Malvinder Singh convinced @DaiichiSankyo there was "no fear or fault" in Ranbaxy. He concealed the PPT/SAR, which @TheJusticeDept had already obtained. He forced employees to follow a script that everything was fine. (4)
The gambit worked. He + Shivinder sold their $2BN in shares to @DaiichiSankyo. From his ongoing CEO post, Malvinder continued to deceive the Japanese, and sell adulterated drugs made w/ fraudulent data. (5)
He ignored Ranbaxy's own lawyers. "You just don't get it!" One of them pounded a conference table, when he continued shipping bad drugs. He threatened a disobedient executive w/ harm. (6)
In 2010, I interviewed @DaiichiSankyo's global strategy head, Tsutomu Une, to ask: had the company been fooled by Ranbaxy. His answer: “I never thought that we were fooled.” (7)
In May 2013, just days after my @FortuneMagazine piece on Ranbaxy came out, exposing the SAR for 1st time, Daiichi Sankyo announced that it had been fooled, and launched a fraud proceeding against the Singhs in a Singapore arbitration court. fortune.com/2013/05/15/dir… (8)
Once the Singhs lost the Singapore proceeding, were on the hook for $500 mil, and couldn't get the judgment nullified in India, they needed cash. Which leads us to yesterday's dramatic arrests. bit.ly/32l3IJm (9)
