ATTENTION: This is terrifying. TRAC (@TRACReports) has been the most important data & analysis resource on immigration cases & detention. This month they noticed “serious inconsistencies” making data requested unusable. Immigration authorities *refuse to cooperate to clear up.*
After reviewing the flawed response to routine FOIA request: “TRAC alerted the Executive Office for Immigration Review (EOIR) to the problems uncovered, & attempted to work with the agency. EOIR declined to provide any assurances of the accuracy of the data it had provided.”
“The issues w/ EOIR’s data inconsistencies [are] substantive, ongoing, & in need of prompt attention. Of greatest concern is the apparent lack of commitment to ensure the public is provided with accurate & reliable data” on US immigration proceedings.

Call them out: NY won historic justice reform this past year. Ended cash bail for most crimes. Prosecutors arent just fearmongering to change law back. They’re spending resources training on tricks to subvert the law to jail people that shouldn’t be jailed.theroot.com/when-n-y-ended…
Last year: “Police unions, prosecutors & “law & order” advocates fought the reforms tooth & nail, contending that it would turn NY streets into “the purge.”

Now: Weaponizing tragic crimes to blame on law changes & going round the state training prosecutors on how to subvert law.
Among the tricks Nassau County prosecutor Jed Painter is going around teaching people to keep jailing more people, are tips to make “judges “believe” that suspects were dangerous, thereby giving courts the option of setting a cash bail where it normally wouldn’t be legal.”

Here is a charging document dated 10/24. Filed by Suzy Loftus. Pledged to stop the war on drugs. To stop criminalizing poverty. Filed 4 counts. Low level drug possession. Marijuana. Sitting on the street. And the most common charge to justify any force used: resisting arrest.
Here’s what likely happened. Start with count 3. A police officer approaches a man who is homeless sitting on the street. Uses the so-called “sit/lie” infraction (i.e. being homeless) as an opportunity to harass him & search his person.

BPD maintains a "gang assessment database" with the Boston Region Intelligence Center, "fusion center" which combines the worst information and impulses of local, state, and federal law enforcement. Their intel on suspected gang members is... well, it's bad. It's very bad.
The database gives BPD cover to "confirm" who is a "VERIFIED & ACTIVE" gang member. It's a serious allegation, something they'd be immediately sued for publicly suggesting about a white Bostonian. But determine that someone is young, male, & Salvadoran.... and here we are:

NIGHT COURT: About to stand on case where my 19 year old client & his girlfriend were jumped by 4 people all older than them. My client has bruises & a stab wound. But he’s charged w/ assault. The reason: the people who jumped him called the cops first. It really is that simple.
This is so common. Even when then there is so much evidence to the contrary. For instance, the people who jumped my client came to his building. They had no visible injuries. The police didn’t even ask my client what happened. It honestly feels crazy at times.
Police often make decisions as to who to arrest in assault cases based on very random factors rather than careful consideration of the evidence. For instance, when one person has an order of protection, they will arrest the other.
