NEW: A federal judge in California partially blocked Trump's plan to reprogram Defense Department money to fund border construction — the admin can't begin two projects that could have started as soon as next week using $1B in reprogrammed funds assets.documentcloud.org/documents/6026…
Remember there are different parts to Trump's plan to fund border construction w/out a congressional appropriation. The judge didn't rule on the use of funds per Trump's national emergency declaration because DOD hasn't said what it plans to do with that money. So TBD on that.
As for the $1B that is at issue now, the judge wrote that the admin's plan to divert that money to DOD's drug interdiction program to pay for border construction "does not square with fundamental separation of powers principles dating back to the earliest days of our Republic"
