Some of the points in this judgment go to my recent two threads on why anti-trans references to "It's simply biology!" and "Don't make me state an anti-science truth!" are red herrings. The tiniest, boniest red herrings. Kick them off the table whenever you see them. 1/
In this case, the claimant, Maya Forstater, contends she was let go as a visiting fellow and consultant because of her view that sex is immutable, and that therefore she'd been discriminated against because of her philosophical views. 4/

There are several references to biology in the claimant's statements. Here are some. 5/
Paragraphs 43-45 of the reasons for judgment summarize submissions re: medical and biological research that goes against what the claimant states. Including a quote from Fausto-Sterling: "This undermines the possibility of using a simple genetic test to determine 'true' sex." 6/
Nice sense of clarity from the judge here: "It is not apparent to the Court that the chromosomal element, amongst all others, must inevitably take on decisive significance for the purposes of legal attribution of gender identity." 7/
This is going to scare my gender critical readers: "The court considered the importance of a person being able to live in the gender to which they had transitioned and not being forced to identify the gender they were assigned at birth." 8/
And even closer to my point about "But biology!" being a red herring: "The Court also rejected a purely biological approach to gender based only on chromosomal analysis." 9/
The judge finds that 1) yes, the claimant strongly believes in immutable and binary sex and is not prepared to be dissuaded (even though she only recently started believing this), and 2) the claimant presents this belief as the fundamental basis for her political activism. 10/
But--bit of brilliance here--the goals and values that the claimant says drive her feminist activism DO NOT ACTUALLY REQUIRE a belief in immutable and binary sex. Plus, such a belief in immutable and binary sex goes against human dignity and rights of others. Nice work, this. 11/
