This design is a common dark pattern so it is surprising that the CCPA modifications would recommend it. Unfortunately, opt-out dark patterns have become all too common, so here's a thread about them. 👇
Trick Questions is a classic opt-out dark pattern. Two statements seeking consent; the first checkbox needs to be unticked to opt out, but the second checkbox needs to remain ticked. This pattern has several variants. Image
Another classic: the opt-out is out of sight, usually tucked away inside a fold or in some other page. How many users even expand the fold?

Sometimes the opt-out is in the last place you'd look.

The @Forbrukerradet documented how Facebook & Google place opt-outs behind a sea of screens. Facebook's GDPR consent flow opt-in takes you through 3 screens, while the opt-out takes you through 8. fil.forbrukerradet.no/wp-content/upl…

Another masterpiece from @harrybr: Image
If not a sea of screens, it is a sea of clicks. Want to opt out? Sure! All you gotta do is untick 300 checkboxes.
Sometimes all it takes is a little color. Is the the grey colored opt-out disabled?

Spoiler: It is not.

If it's not clicks and screens, it's language that scares and confuses.

"You'll no longer be able to block or mute some ads"? What does that even mean?! Image
Finally, it's good old coercion. Let's just eliminate the option to opt out altogether.

I've been receiving emails from @express since 2015. I don't want to call them to opt out of promotional emails! Image
If you've seen other types, please share! As we wait for GDPR and other laws to kick in, let's raise awareness and call out the companies that use these manipulative tricks.
