Erm....
The new NI Sec is implying that the deal negotiated this year will negate the need for a border. Unless there’s perfect alignment/GB would be part of EU customs territory, there will be. This is something the govt has *already* signed up to. It’s not a matter of negotiation.
Either the minister isn’t aware of this pretty crucial part of his new brief and the deal the PM negotiated or he’s misinterpreting the facts.
Or, I suppose, the govt is willing to renege on the Withdrawal Agreement itself.

In case you missed it (shame on you), last night’s piece from me, @maya_rstw and @LondonLuke, at the first post-Brexit EU Council and a Brussels wondering ever more what Britain will do next and whether Boris Johnson will keep his word.
Leaked document in my report is current draft of EU negotiating mandate. Has been revised and tightened already. Am told it may be again before it’s signed off before Tuesday cut off. Eg underlined are key additions from last draft on level playing field commitments.
And more level playing field requirements...

Angela Merkel arrives for what is surely her last round of EU budget negotiations (probably)
As he walked off, I asked Emmanuel Macron if he’s missing the British at this summit. He stayed silent and grinned widely.
Truth is of course, they’re already missing the British in one respect- the cash. One of the big problems of this summit is the black hole that Britain’s large former contribution, has left.

Back in Court of Session. Case before Lord Pentland by @JolyonMaugham claiming interdict against UK Ministers on grounds that the proposed Brexit Withdrawal Agreement breaches existing law on the customs status of Northern Ireland.
Aidan O’Neill QC appearing for petitioner. Will speak for 1 hour 30. Begins by stating that petition anticipated the contents of the Withdrawal Agreement - and was largely correct. Claims it breaches section 55 of Taxation (Cross border Trade) Act 2018 on Northern Ireland.
O’Neill: There is not yet an Agreement under EU Law - at it is not passed by the European Parliament as required. So this remains a live legal issue.

Had lots of questions regarding proposal I set out. Have been, and will be, largely staying quiet because I believe negotiations at a critical stage & should all be cautious about our interventions. But have tried to answer some questions in the thread below (all views my own) /1
Q: Isn’t it same as NI only backstop?
A: Two crucial differences.
1. Entire Protocol subject to broad consent in NI & as such cannot keep NI locked in indefinitely if consent isn’t there
2. Customs approach allows NI to be in UK’s customs territory & take part in any UK FTAs /2
Q: Isn’t it same as current deal?
A: Crucial changes to the backstop. Deals with two key concerns - that the UK would be trapped indefinitely in a customs union against its will & that a UK wide customs union is starting point for future negotiations. /3

UK freight forwarders/ brokers cannot recruit #customs specialists in sufficient numbers. The same way UK Gov cannot hire customs clerks, customs officials and the 500 border force officers Sajid Javid promised /1
First, as many incl @LeftPeggers pointed out, we don't have them in the UK (#customs is country specific, to a certain degree even within the EU, also not sure EU customs ppl would want to come work in the UK). /2
@LeftPeggers Second, customs is not something you can learn from a book as a lot of it requires direct experience. It's very different from other areas of tax where most rules are written down clearly (which still of course require direct experience)- customs rules are ambiguous at best /3

In a Transition Period, following the #WithdrawalAgreement, the movement of goods between the UK and EU remains free flowing.
During this time, the negotiations on the future UK-EU trade agreement will be underway.

If at the end of the Transition Period, there is no UK-EU FTA close enough to avoid a hard Irish border, the backstop will kick-in on a temporary basis.
It has both NI-specific and UK-wide dimensions to minimise controls needed across UK land & sea borders.

Thread on #customs transit. Why it isn’t a #Brexit silver bullet and why proposals for NI border relying solely on transit would make it one of the most restrictive borders out there (even if we managed to get to no infrastructure). Might get long /1
Transit is an existing customs procedure. Allows to move customs formalities away from the border and only scan a barcode when passing the border. In some cases transit can start or end at company’s own premises. (Bit more on it here) /2

No deal so far, “not at all” though some progress. No further negotiations until EU summit now.
“A number of unresolved issues relating to the backstop” says No10 & Dexeu - confirming that if there is progress will be at Summit now at Leader level
... so it isn’t just the timing issue.
There is the issue of the EU side tabling a default backstop or “backstop to the backstop” which is the same as the “unacceptable to any UK PM” draft the EU published in February - making NI part of EU customs territory etc
