The case was made possible by the #EnergyCharterTreaty (ECT) which allows corporations to sue countries in secretive tribunals (ISDS) over policy decisions that affect their current, and projected future, profits. 2/6
The case came after the local community in Abruzzo, Italy, ran a successful grassroots campaign to stop the construction of Rockhopper’s planned oil rig off the coast, that would have devastated their homes and livelihoods. 3/6

(1) the ECT integrates sustainable development as a core principle but needs to be updated since the EU/UK have greater commitments (now is effectively done)
(2) criticism towards investment arbitration is not about ECT, and it has not been subject to the modernisation process nor in the mandate of the Energy Charter Conference, it only addressed compatibility with EU law (now done by exempting the EU from intra-EU investment cases)

Spain is the most sued country under the Energy Charter Treaty: it accumulates 50 lawsuits and a claimed amount of more than 10 billion euros. The solution is very simple: to avoid this waste of public money, the exit from the Treaty must be initiated.
In a claim under the #EnergyCharterTreaty it can never be said that "the State has won": the defence costs alone amount to millions of euros. As in the case of Abengoa Spain, Spain will have to pay 6.7 million taxpayers money only in process costs.

This is a really good film (10 mins, with subtitles) about how the #EnergyCharterTreaty prevents climate policies by allowing companies to sue the governments for any claimed loss of profits.
It reveals how ECT secretariat is biased against energy transition (contrary to their claims), and how ECT is increasingly controversial among EU govts. But a govt can only decide to withdraw from the treaty by giving 20 years' notice! Yes, twenty
Since any single country is prevented from acting democratically, the @EU_Commission should demand wholesale reform of the treaty to prevent it applying to climate policy, or European countries should collectively withdraw.
