DOJ — given 48 hours to go to #SCOTUS following this afternoon’s 2nd Circuit ruling that Commerce Sec Ross has to sit for a deposition in the Census citizenship question challenge case — acts quickly, filing this evening requesting a stay from #SCOTUS.

NEWS: Justice Ginsburg orders a response by 4p Thursday to the stay request in the Census citizenship question case and stays the district court’s orders (including the Ross deposition order) pending the filing of that response and further order from her or the full #SCOTUS.
Ginsburg is the “circuit justice” for the 2nd Circuit, meaning applications of this type go first to her. The circuit justice can act alone or refer such requests to the full court (which she’ll likely do once the response is in).

BREAKING: Supreme Court denies the foreign country-owned company's request to stay a contempt order resulting from its refusal to comply with a grand jury's subpoena. Chief Justice Roberts' "administrative stay" is vacated, so the result is the contempt order is back in effect.
That order of the court follows this request, made Monday but put on the docket today, to file a cert petition in the case under seal. Not clear what will happen with that now, but the contempt order (and associated fines) will now be back in place.

#SCOTUS, Jan. 8, 2019. With most of the sights in DC shut down, the Supreme Court is drawing a big crowd even for relatively low-profile cases.
It's a one-box Tuesday here at #SCOTUS, meaning one or two decisions in argued cases should be coming at 10a.
The first decision is Justice Kavanaugh's first majority opinion, in Henry Schein, Inc. v Archer & White Sales, Inc., vacating the 5th Circuit in an arbitration case. The decision was unanimous. #SCOTUS

NEWS: #SCOTUS greenlights nearly all discovery in @NewYorkStateAG & co's #2020Census case, except for Sec. Ross deposition which remains on hold pending further briefing (despite an inaccurate AP story that he “can’t be questioned,” period).
DOJ just filed another motion with the district court to stay @NewYorkStateAG’s #2020Census case ahead of our Nov 5 trial. That’s right - after asking #SCOTUS to stay discovery and losing, they’re trying again with the district court. Seriously.
In our latest filing with the district court, @NewYorkStateAG notes that FOURTEEN judges have thus far rejected DOJ’s efforts to halt her #Census2020 suit.

On this Independence Day, when we celebrate the U.S. as a democracy and as we await a Scalia-like successor to Justice Kennedy to be nominated for #SCOTUS, some thoughts on how the Court could set the cause of voting rights back significantly in the years to come: /1
The first way that the Court can negatively affect voting rights is by holding that democracy-enhancing laws like the Voting Rights Act or campaign contribution limits are unconstitutional. The second way is by upholding state laws making it harder to register and vote. /2
In the first category, at the top of my list is that #SCOTUS with a fifth hard conservative on race could either hold that Section 2 of the Voting Rights Act is an unconstitutional racial classification or interpret it so weekly it dies death by 1,000 cuts /3

2. So far, there are 6 lawsuits against the #2020census citizenship question, which Commerce Secretary Wilbur Ross (census overseer) approved adding to questionnaire. More than two dozen states & cities, plus other groups & individuals, are trying to get it removed.
3. Lawsuits include:

- The NY Immigration Coalition et al v Commerce Dept et al

- State of CA v Ross et al
