Of the three cases in which DOJ is seeking #SCOTUS review, only one has even been argued before an appeals court. Karnoski, an appeal out of Washington state, was argued on Oct. 10 at the 9th Circuit. You can watch it here: ca9.uscourts.gov/media/view_vid…
The Doe case out of DC is due to be argued before the DC Circuit on Dec. 10. The appeal in Stockman, out of California, was only filed in the 9th Circuit on Nov. 16, so the appeal has not yet even been briefed.
Meanwhile, in a move that will become relevant in the days and weeks ahead, DOJ filed a motion in the district court in DC last week, asking for the injunction in Doe to be stayed pending appeal. documentcloud.org/documents/5279…
DOJ "respectfully requests" a ruling by Dec. 3 on the stay request, bc it plans on going up to DC Circuit & SCOTUS if it doesn't get a stay from dist ct. (This is similar to DOJ's move w/ Karnoski on the preliminary injunction appeal, giving a date by which it wanted a ruling.)
On Sunday, the district court judge overseeing the Doe case — Judge Colleen Kollar-Kotelly — ordered a response by Wednesday.
