The data protection adequacy decision is technically separate from the EU/Japan free trade agreement that comes into force next week, but is implicitly linked to it politically - and note that it's reciprocal, data flows in both directions are simplified -
Compare to Brexit
Under the withdrawal agreement EU data protection law still applies to UK during transition period, & an adequacy decision process would be started.
If no deal, no adequacy decision, although this limits data flows, not bans them - p 11: ec.europa.eu/transparency/r…

Two interesting ECHR rulings today
Catt v UK - police data held on 94 year old activist in extremism database was justified in principle, but unjustified in the circumstances. Breach of the right to privacy.
And the Amanda Knox case. Breach of the ECHR freedom from degrading treatment, and breach of the right to a fair trial.
In the Amanda Knox case there was a *procedural* breach relating to degrading treatment - ie no adequate investigation of her complaint. No funding that she actually suffered such treatment.

1/ Some thoughts about the UK "rolling over" trade agreements in a no deal scenario. These are mostly general points, but I also have a specific point about the UK/Israel agreement that's just been announced.
2/ So far 'roll-over' FTAs have been announced with Switzerland and Israel, and agreement to roll over mutual recognition treaties has been announced with Australia and New Zealand. The DTI says Mr Fox is meeting with Canada, Colombia and others in Davos: gov.uk/government/new…
3/ Unfortunately the text of these treaties is not available, so they can't be compared with the comparable EU treaties now in force. But since the intention is to retain (for now) the status quo, the claim by the DTI (and Israeli govt) that they will "boost" trade is misleading.

Ok, Government's basically just admitted "International hauliers, if there's a no deal Brexit, you're bust."

You see, they may need ECMT permits. But only a little over 1,000 permits were available (for 50,000+ vehicles) and application deadline passed.

1/ Accounting. UK accountants no longer considered statutory auditors - oh no! - ... "for the purposes of the [EU's] Statutory Audit Directive" or SAD :)

2/ But the Satutory Audit Directive is a classic EU double negative legislation. It only forbids EU member states from not recognising auditors that don't meet the SAD requirements. Sad

1/ Let’s talk about trade
2/ Some of the arguments made in favour of Brexit are the UK’s ability to negotiate its own trade deals, most growth will come from outside the EU, the EU is “protectionist” and slow at negotiating trade deals.
3/ As we rapidly approach 29 March 2019 where the UK will have no trade deals to its name & is asking the EU to include the UK in its FTAs (& stay in the single market & customs union in all but name but with no influence) during the transition, the UK is not in a great position

1/A few rather anticlimactic observations on 🇮🇹:
- There is no need for Italy and the @EU_Commission to agree.
- Nothing will immediately follow from this whole circus now.
- The real showdown will happen next summer - most likely after the EP elections.
Some details:
2/ First, for all the macro details, read the excellent analysis by @gregclaeys.
Second, it is a fallacy to think that 🇪🇺 and 🇮🇹 have to agree now. If the Italian govt refuses to revise its plan, the Commission will report this and its objections to the Eurogroup. And that's it.
3/ The DBP procedure is an early-warning system for potential future breaches of the rules. The Commission has no leverage to force Italy (or any government) to revise its plan according to its objections. It can just signal its objections to the public and the markets.
