A new joy of #Brexit: the Constitutional Reform and Governance Act. PM confirmed to Dominic Grieve that the provision in it to lay any new treaty in front of Commons for 21 days before it’s voted on will have to be ripped up to pass Brexit deal bill in time for March 29 (1)
She proposes to do this with new legislation to overrule CRAG. But until that new law passes, any vote tabled on the Withdrawal Agreement Bill will technically be an illegal act. Furthermore, anyone could attempt to judicially review it (2)
So if the PM can pass a deal before March 29 (still a big if), will new court action be the thing that finally forces an Article 50 extension, or will it be the Lords if it sits on CRAG reform for weeks? All goes to show how Parliament is still a massive obstacle for May (3)
