@JolyonMaugham Govt seems to be regularly losing cases on benefits reforms - and they are now often pure human rights claims. My impression is that at the outset of austerity courts were more reluctant and claims sometimes avoided human rights arguments for more orthodox Judicial Review ones
It shows the power of the Human Rights Act and proportionality reviews. Illogical and ‘manifestly beyond reasonable foundation’ policies should be challenged and the courts should have the confidence to strike them down
