The NYT is now telling us flat out that if Mueller merely recites what's in his report, it's a win for Republicans:

This is exactly what I feared would happen. This framing tilts the field in favor of Trump.

But as I argued yesterday...

The report itself is damning enough:

The framing has become: "Will Mueller stick to the report, or will he reveal new information?"

This is a setup. Mueller's recitation of information in the report, much of which is incredibly damning, will be deemed "not new" and therefore a "dud."

That is correct.
Here's the video of this exchange:

It's still not clear to me whether Mueller actually meant what he's saying here. He could have still been thinking he was in theoretical mode.

However, even if that's so, having it explicitly confirmed from Mueller himself that an indictment was *precluded* is important.

1) There's something very perverse at the core of the Mueller situation, and we shouldn't let it get lost.

When Mueller is asked to say explicitly whether he concluded Trump committed criminal obstruction, he likely won't say.

Why? Out of an abundance of fairness to Trump.
2) It's important to understand that William Barr cynically exploited this sense of fairness on Mueller's part.

Barr did this by suggesting that Mueller *could have* given his *personal* opinion on whether Trump committed criminal obstruction, even absent charges.
3) But we know from Mueller's report that he would not be comfortable doing this, because as Mueller himself said, absent trial, Trump would not be able to defend himself.

This is probably why he'll continue to refuse to answer the question tomorrow.

Stephen Miller is playing an ugly game. He claims Trump disagrees with the "send her back" chant, while echoing Trump's message about the nonwhite lawmakers in every other way.

Let's just say it: Miller is talking to white voters.

Second, there’s a strange mismatch between the pace of the super-fast “no obstruction” decision, versus not-so-fast #Mueller report vetting.

Obviously, Barr wanted to get the no obstruction finding out in his summary letter.
Reviewing thousands of pages of evidence to make a complex, fact-intensive legal conclusion on obstruction ought to be as time intensive as vetting a 400 page report for material that shouldn’t be released.

The fast-train/slow-train contrast is odd.
