I’m not sure what’s so hard to understand here. The presidency, the Senate and the Court are all in the hands of a political minority that will use any procedural escalation to preserve its power. 1/
The conservative Court majority was obtained by a previously unthinkable maneuver and uses its power to reinforce Republican power and interests at every level across multiple domains. 2/
Dems will have enough trouble just winning power in this backwards system. And if they do, they are supposed to just sit back and watch this Court full of minority-party appointees and abusers smack down every law they pass? 3/
“Republicans will do it too” is such an empty critique. A) They already did it in 2016 and B) “The party in power controls the Court” is vastly preferable to “long dead minority has icy grip on politics for 25 years” 4/
No one has an answer to this except either hope Thomas retires or watch the next two Dem governments implode so that we can preserve the sanctity of the Courts. 5/
Furthermore, the credible threat of court packing might be the only thing that brings Rs to the table for a settlement in the form of a Constitutional amendment. Otherwise why would they stop escalating? If Dems roll over again, next time it will be worse. 6/
Let’s say Warren wins, Thomas dies/retires and RBG and Breyer are replaced with youngsters. Rs win in 2024. You really think this crew wouldn’t expand the Court? Really? Do you have -any- evidence supporting the idea that the Republican Party would exercise forebearance? 7/
Kill or be killed. You can thank Rs for the world we live in. But it is what it is. Pack the courts. 8/
