Worth remembering that Robert Bork didn't think the First Amendment applied to songs. Or movies. Or novels. Or most history books.
(This is not hyperbole, by the way. It's the explicit argument of a law journal article he wrote two years before he became Solicitor General of the United States.)
The conservative political rehabilitation of Robert Bork rests entirely on the fact that his nomination happened so long ago that most of us have no idea how respendently horrifying his views on the constitution actually were.
Bork got a fair hearing and a thorough vetting, and was roundly rejected in a bipartisan Senate vote because of his long history of flamboyantly vile words and deeds. Reagan then put up a less preposterous nominee who was confirmed unanimously. That’s the Bork story.
Also: Six Senate Republicans voted against Bork, but only six, even after it became clear that he was manifestly unfit for the Court. Hyperpartisanship isn’t as novel as is often claimed.
