Maybe send some federal agents over while the “whistleblower” is in the shower, invite them for a friendly “chat” down at federal plaza, then ambush them for several hours with no lawyer, and charge them with 1001 lying to feds if they misremember a date. Call it “Mueller time”?

Just to correct some reports I saw yesterday, Andrew McCabe has NOT dismissed his wrongful dismissal lawsuit against the DOJ and FBI - at least not yet. He dismissed his related *FOIA* lawsuit.

So keep your popcorn on standby for now🍿

Case 1: FOIA (18-cv-01389) - filed May 2018
Case 2: Wrongful dismissal: (19-cv-02399) - filed Aug 2019
The FOIA case (01389) sought documents related to his firing, such as the Inspector General internal manual and other docs

Very late on Friday, McCabe filed to dismiss this lawsuit - but NOT the wrongful dismissal one.

WB complaint alleges that on Jul 26 (a day after the Trump/Zelenskyy call on Jul 25), US Ambassador Volker met in Kiev to help Zelenskyy “navigate” Trump’s demands to look into Joe/Hunter Biden (which WB calls “interference in the 2020 election”)
But, Volker wasn’t on the Jul 25 call, received only “superficial” readouts of it, didn’t know that Biden’s name was even mentioned, and wasn’t aware that any request was made to investigate Biden either

For no substantive reason other than as a veiled warning to back off, Van Grack includes an email sent by Devin Nunes HPSCI staffer Derek Harvey via Barbara Ledeen to Flynn, which Flynn’s prior defense team immediately turned over to the gov (& it appears not for the first time)
This aligns with Flynn’s defense team also turning over the voicemail from Trump’s WH lawyer Dowd to Mueller, which Team Mueller then misrepresented and truncated to remove context when producing the transcript in the Mueller report

With all of the attacks on the Intelligence Community #whistleblower whose Complaint was publicly released to Congress, it’s time to review some basic principles of federal #Whistleblower protection law.
In 2012, Congress strengthened the #Whistleblower protections for federal employees. In 2013, President Obama extended similar protections for intelligence community employees through a presidential directive & in 2014 Congress codified those protections for Intel employees.
Under the 2013 presidential directive, any #whistleblower reprisal claim must be adjudicated consistent with the policies and procedures used to adjudicate reprisal claims filed under the Whistleblower Protection Act, 5 USC 2302(b)(8).
