LAWSUIT UPDATE -- COMPLETE VICTORY AGAINST THE #ArizonaMafia's RETALIATORY LEGAL ATTACK ON ME. Some of my friends and family, particularly those who followed my former career in Arizona, may recall I had been involved in a civil litigation lawsuit with former business partners.
This update is to confirm that this most recent legal attack -- and it was a bad one -- has recently been completely dismissed, with prejudice, by the Arizona court. (See screenshot at the end of this thread) With this awful chapter behind us, there are some lessons here.
First of all, it was the third time I have been attacked with an extortion-style civil business lawsuit by a former business partner. This time the attacker was none other than former (disgraced) United States Attorney Dennis K. Burke, a corrupt lawyer who was previously fined
and sanctioned by the Arizona Bar in April, 2014 for misconduct including lying and retaliating against a co-worker during the well known "Fast and Furious" illicit weapons trafficking scandal. Seems Burke has a history of retaliating against co-workers. What's the lesson? Give
some serious thought and consideration to who you get in to business ventures with. This guy had a history that manifested when he didn't agree with the timeline of our business development. In retrospect, we could have seen him coming, but apparently my eternal optimism about
people was an impediment in that regard.

but twenty-one Plaintiffs (former shareholders) who were persuaded by Burke to put their names on the lawsuit with intentionally misstated facts designed to help Burke's own personal agenda, not them.

on the Arizona court (and his own lawyer friends) in order to retaliate against a co-worker, "through other people" like the coward he is. When his own lawyer called to acknowledge Burke's lies, it showed character we don't always see in the legal profession.
And it was a very well known Arizona lawyer, frankly known as a "bully", who I didn't expect to own up to lies that were made on HIS side of the case. This was impressive to me; didn't expect it, I'm refreshed to see such ethics in a profession where it's increasingly risky to
admit one's mistakes. When it became clear their lawsuit was falling apart, the lawyer in question, who is an older gentleman, flew five hours by airplane to see me in person, take me out to dinner and discuss everything that had happened. Couldn't believe it.
Then he handed us information about Burke's intentionally misstated facts, for us to use in our lawsuit against Burke. Couldn't believe that, even more.

article planted in the Arizona Republic newspaper by Burke as part of his retaliatory campaign that was seen by many people. For this reason and others, in December 2018 I filed a responsive lawsuit against Burke, his co-conspirators, and the Arizona Republic newspaper in
federal court in Massachusetts. My lawsuit against those parties remains outstanding.
In recent years, Massachusetts juries have not been soft on parties about retaliation in a business context. It may be up to them to decide Burke's fate in this matter. We will be asking them

to send a strong message to others who may consider retaliating against co-workers the way Burke did here, as they have in several recent decisions.

leaving only my lawsuit against him. For the lawyers in my feed, you will understand how the Res judicata created here speaks to other parties -- whoever they may be, conceptually -- who may consider following a similar misguided agenda; who may have been encouraged by Burke or
his partners to do so, the way he encouraged the twenty-one Plaintiffs in the Arizona case who are now left hanging with a problematic case history to consider themselves.

Burke's ill-conceived lawsuit against me is concerned, and it's back to work on more positive things.
