Think the politics will find a way. Senior EU officials telling me its not impossible there's a final legal text tonight/tomorrow. But if there isn't, then: 1) After holding indicative vote on draft deal, BJ (or whoever) cd write & request 3 month A50 extension. EU wd consider 1/
request. But by time next Council rocks round, legal text finalised, so they wouldn't offer full 3 months. Or BJ forced to request 3 months, EU offers "flextension" - so it falls away once legal text agreed, & fully ratified etc in Commons. Much shorter than 3 months 2/
Politically, don't think extension hurts BJ if he's delivered draft deal that wins backing in Commons on Sat. To his base he'll be a national hero: delivered Brexit, binned the backstop & won right of free trade for GB. Will an academic A50 extension hurt him? I'm sceptical ENDS

So what's going on with the French position on Brexit? Some thoughts after chats. Senior French officials say their position will remain unchanged: no long delay to Brexit without a clear reason – ie an election or referendum 1/
A shorter extension – maybe 2 or 3 weeks - is possible to allow the Withdrawal Agreement Bill to get through the Commons. If WAB fails, and an election is called, then yet another extension could “reluctantly” be considered 2/
Several factors complicate the French position. Firstly, Macron is in French overseas department of Reunion in the Indian ocean, where he has been greeted by demos & a general strike. His mind & body are in a different time zone. It’s difficult to get him to concentrate on Brexit

Think we are moving to an election. No more Lab-Con talks planned on Bill timetable. Labour sources accuse Boris of not being serious about getting Bill through. No 10 expects EU response Friday. If extension mentions 31 Jan, Boris will apparently seek election immediately 1/3
Will warn that Parliament would use any opportunity to delay Brexit. Aides think he would get it through possibly with SNP support (as I said this AM). Labour officially says it will back election once no deal threat removed. But privately it is having cold feet 2/3
May hide behind fear of new cliff edge 31 Jan. PM controls the actual date so in theory could call February election & crash out in campaign. Though not very realistic. No 10 aides planning for late Nov/early Dec election. Dec more likely - poss 5 Dec ENDS

Diplomats were saying yesterday that to have any chance of getting through, a legal text clarifying the above was required yesterday in order to translate the fine detail into all the EU languages.. that didnt happen.
