FYI, the ABA's secret evaluator here is Marcia Davenport. crowleyfleck.com/biography/marc… The letter fails to mention that she may have a political ax to grind. She donated to Lawrence VanDyke's political opponent in the 2014 Montana Supreme Court race. appecm.mt.gov/PerceptiveCPPC…. Oops.
Lawrence VanDyke:

Magna Cum Laude, Harvard Law

Editor, Harvard Law Review

Law Clerk to Judge Janice Rodgers Brown, DC Circuit

Only person to serve as state solicitor general for 2 states (NV & MT)

24 federal appellate arguments

Counsel of record for 39 Supreme Court briefs
No court has ever reprimanded VanDyke.

Who are these 60 individuals who the ABA claims they interviewed?

What did they say? Recordings? Transcripts? Notes? Reports?

Who was the second reviewer? Why didn't this person contact VanDyke?

Will the ABA release this secret evidence?
The ABA letter falsely claims that Lawrence VanDyke "would not say affirmatively that he would be fair to any litigant before him, notably members of the LGBTQ community." In fact, he flatly told the secret ABA evaluator (Marcia Davenport) that he would be fair to all litigants.
And according to the ABA's own website, Lawrence VanDyke represented the group "Gays and Lesbians for Individual Liberty" in an amicus brief filed with the Supreme Court of the United States back in 2010: americanbar.org/content/dam/ab…
The ABA's political drive-by shooting of Lawrence VanDyke -- literally on the eve of his confirmation hearing tomorrow morning -- feels a lot like what they attempted (and failed) against Judge Steve Grasz on the Eighth Circuit: c-span.org/video/?462242-…
Here are the 2 bottom lines:

(1) The ABA is a liberal dark-money group, fronting for trial lawyers who donate millions of dollars to Democrat politicians.
(2) The ABA's evaluation of nominees is fatally flawed, as it is intentionally structured to couple liberal activists (like Marcia Davenport) with a subjective, black-box process that oftentimes results in unfair hits on conservative judicial nominees (like Lawrence VanDyke).
In his sworn testimony today before the @senjudiciary, Lawrence VanDyke flatly denied under oath the ABA’s allegation that “Mr. VanDyke would not say affirmatively that he would be fair to any litigant before him, notably members of the LGBTQ community.”
.@senjudiciary should refer this matter to @TheJusticeDept to determine whether the ABA, including its evaluator Marcia Davenport, provided materially false statements to Congress, a felony in violation of 18 U.S.C. Section 1001

State bars should also open ethics investigations
