BREAKING: Judge dismisses the lawsuit regarding Ukraine testimony from Bolton deputy Charles Kupperman, declares case moot.
Importantly, both the House and White House sought this outcome. Intel committee investigators withdrew their subpoena of Kupperman, trying to disentangle the case from legal fights amid impeachment proceedings. White House said Kupperman was “immune” from testimony.
Kupperman has asked for the case to continue because he could still face consequences if House reissued subpoena or held him in criminal contempt. Judge Leon said neither were going to happen.

And even if they did, the case would be right back in court.
Underscoring that point, Leon notes that the House’s article of impeachment charging Trump with obstructing Congress lists 9 officials who Trump blocked from testifying. Kupperman isn’t one of them.
THE LATEST: Leon’s ruling essentially closes the door on the last known legal loose end for the House’s Ukraine inquiry. It leaves an earlier DC district court ruling rejecting ‘absolute immunity’ as the only one standing. politico.com/news/2019/12/3…
