All gun transactions. Meaning that when a person who owns a gun sells that gun they’d have to require the purchaser submit background check. The problem here is that such a law is virtually impossible to enforce unless you also create a national and retroactive gun registry.
There are hundreds of millions of gun in private circulation. The vast majority of those guns aren’t registered to any private citizen. The gov’t has a record of their existence (serial number) but no record of who owns them. Those guns can be bought and sold without a BGC..
The only way to enforce A BGC is by having all of those millions of guns registered to an owner, the only way to enforce a registry is to confiscate unregistered guns and arrest the owners who didn’t register them....
In summary, Yes, we can pass Universal Background Checks alone, and yes some meticulous citizens will willingly comply. But those set on evil will easily by a gun from anyone who’ll simply chose not to go through the hassle. Majority of gun sells won’t comply and we’ll never know
If we chose to create a national gun registry as a means to enforce universal background checks we’ll be signing off on a national effort to confiscate from and prosecute gun owners who don’t register their firearms. We’ll make criminals out of law respecting citizens overnight..
And give our government an absolute power over not only our second but also fourth amendments. In closing, a Universal Background Check May happen, a registry won’t happen and the result would be retroactively prosecuting citizens who don’t abide, AFTER the transaction.
ONE place a universal background check would be effective: gun shows. private citizens show up to gun shows, rent a space and put dozens of gun on a table for sell and call it “private citizen to citizen transactions” not every state allows this, but it isn’t federally prohibited
We can change that without UBGC-If you’re selling guns, at a vendor event, with the intent to make a little money, you should be required to have an FFL-Boom the mysterious “gun show loophole” is fixed forever and always(although not many guns purchase this way are use illegally)
