About Chief Justice John Toberts, Trump pulls back a bit, saying, “I have a lot of respect for him, I like him and I respect him, but I think we have to use some common sense.”
“Everyone files in the Ninth Circuit,” Trump says. “I haven’t seen anyone file any place else.” This is not true. The travel ban had cases all over, including a major one in Maryland that was appealed to the 4th Circuit. Trump lost there as well.
Sanctuary city and DACA cases, also, were filed all over. A sanctuary city case was filed in Chicago, where the judge ruled against the administration. DACA rulings against the administration have come in DC, MD, and NY (that I recall off-hand), in addition to CA.
On forum-shopping, which is what we call Trump’s complaint, he says, “You can go any place in the country, and I think we’re going to have to stop that somehow. The judges are going to have to get together or Congress is going to have to get together and stop it.”
Of course, Trump is right that many cases challenging his policies are filed within the 9th Circuit—just like a lot of cases filed against Obama policies were filed within the 5th Circuit. It’s not clear at all, though, what Trump would change about that. (Or what he could.)
