“The illimitable nature of the @POTUS’s law enforcement discretion stems not just from the Constitution’s plenary grant of powers to the president, but also from the ‘unitary’ character of the Executive branch itself.” From The Once and Future AG’s 6/8/18 memo.
If you don’t understand this argument —and many lawyers much less non-lawyers wouldn’t—it isn’t a good idea to speak loudly or even softly on the issue. Barr’s memo is a comprehensive and persuasive argument against expansive prosecutions of any president.
Impeachment in the House and trial in the Senate, as outlined by Hamilton in Federalist 69, is the only responsible means to attempt to remove a president, never via indictment.
The entire memo from former AG Barr here: documentcloud.org/documents/5638… It is a very fine piece of analysis and argument and will certainly absorb attention of @senjudiciary. It does NOT constitute grounds for recusal from supervising SC Mueller. It is an opinion, not a participation.
