On Thursday, April 18, 2019, the @NGRPresident @MBuhari signed into law the National Minimum Wage Bill 2019.

In today's edition of #HRwithEM #TwitterSession #TweetChat, I would be reviewing the key highlights of this new law. #MinimumWage
Section 2 of the law clearly states that the law is applicable throughout the Federal Republic of Nigeria. #MinimumWage #HRwithEM
Every employer (public and private sector) except exempted are required to pay a wage that is not less than N30,000 per month to every worker under their establishment. #MinimumWage #HRwithEM
No employer can enter into an agreement with a worker to pay an amount that is less than the #MinimumWage. #HRwithEM
The current #MinimumWage will be subject to review every 5 years. #HRwithEM
Those exempted from the #MinimumWage are:
1. An establishment in which workers are employed on a part-time basis.

2. An establishment at which workers are paid on commission or on piece-rate.

3. An establishment employing less than 25 persons. #HRwithEM
4. Workers in seasonal employment such as agriculture, and

5. Any person employed in a vessel or aircraft to which the laws regulating merchant shipping or civil aviation apply.

Failure to comply is considered an offence and upon conviction, three levels of penalties will apply. #MinimumWage #HRwithEM
1. The employer will pay a fine not exceeding 5% of the offenders monthly wage;

2. Pay all outstanding arrears of the workers' wages; and

3. Pay an additional penalty of not less than the prevailing @cenbank lending rate on the wages owed for each month of continuing violation. #MinimumWage #HRwithEM
Employers are required to keep a record to show compliance and to retain this record for a period of three years after the period to which they refer. #MinimumWage #HRwithEM
Failure to keep and maintain this record will attract a fine not exceeding N75,000, and an additional penalty not exceeding N10,000 for each day the offence continues. #MinimumWage #HRwithEM
The law empowers an aggrieved worker, Trade Unions and the Minister of Labour and Employment to seek enforcement of this law. #MinimumWage #HRwithEM
Refusal to provide required information or providing false information with regard to this law attracts a fine not exceeding N250,000 or a prison term not exceeding 6 months or both. #MinimumWage #HRwithEM
The law defines a "worker" to mean any person who has entered into or works under a contract with an employer whether contract is for manual labour or clerical work or is expressed or implied or oral or written... #MinimumWage #HRwithEM
...and whether it is a contract of service or a contract personally to execute any worker or labour, but excludes the exemption contained in this Bill. #MinimumWage #HRwithEM
There is the need for all #HR professionals to now review the wages of all contract workers outsourced to their organisation in order to ensure that they do not contravene the provision of this new law. #MinimumWage #HRwithEM
