1/ Thread on Apple v. Pepper. Now that J. Kennedy retired, RBG will usually be the most senior Justice in a left-leaning opinion. (J. Stevens long held that role). And for Ginsburg's first assignment, she picked J. Kavanaugh #SCOTUS
2/ The majority opinion makes no reference to the four-member dissent. J. Gorsuch brings the fire: the majority "replaces a rule of proximate cause and economic reality with an easily manipulated and formalistic rule of contractual privity." Plus "blind formalism."
