BREAKING: @TheJusticeDept confirms that, while they have "been asked to reevaluate all available options," they are NOT adding the citizenship question back to the #2020census at this time and will reveal next steps by July 5 at 2 p.m.
The DOJ and Commerce "have now been asked to reevaluate all available options" following the SCOTUS decision and whether the ruling "would allow for a new decision to include the citizenship question on the 2020 Decennial Census."

Amazing when this sentence from U.S. government attorneys represents something of a reveal.

NEW from attorney David Boies: "The victims have been notified--sometimes directly by the prosecutors, sometimes through their lawyers."

A major fault of the Florida plea deal was the lack of victim notification, which a federal judge ruled made the agreement illegal.

The DOJ swapped out attorneys on the census case without explanation.

Reminder: SDNY previously withdrew representation in the Census lawsuit, before being replaced by the last Main Justice team.

Judge Furman had questions about that and probably will about this too.
This was a footnote from one of Judge Furman’s rulings strongly suggesting that SDNY didn’t want to touch the #2020Census, noting he “could only speculate” as to the reasons for their withdrawal.
The WaPo’s lead rightly highlights how the DOJ’s latest census shake-up “possibly signal[s] career attorneys’ legal or ethical concerns” over the Trump admin’s maneuvering. washingtonpost.com/world/national…

This is not rocket science, friends.

Asking the #citizenship #question is #necessary for the #federal #government to #fulfill its #role in #advising #Congress regarding #enforcement of the #constitutional #right to #vote.
So it is #perplexing to read #newsreports that @TheJusticeDept is searching for a #path to #inclusion of the #citizenship #question.

Why is this a #puzzle for you?
The @uscensusbureau must do the best it can to accurate #ascertain #both the #number of #persons and the #number of #citizens.

Per White House pool, Trump said he's "thinking of" using executive order to get the citizenship Q on the 2020 Census.

By 2pm, DOJ has to file a notice either confirming they're dropping the Q or giving a proposed sched for next steps if they're not, see: buzzfeednews.com/article/zoetil…
Just in: The judge in SDNY census citizenship Q is going to hold off scheduling a hearing for now, citing the 2pm update deadline in the Maryland case and DOJ's representation that they'll notify the court "immediately" if circumstances change

They’re trying to cause confusion so that some people will not respond to the census questionnaire, whether or not the citizenship question is actually added in there.

Just gaming this out: Per the Census Bureau, 95% of people get the invitation to complete the census by mail. You can respond online, by mail, or by phone. Even if most people respond online, per this fact sheet, the paper form has to ask the same Qs or else it doesn't work

I hope everyone is paying more attention to the health of our democracy in this administration. Today's 2 decisions from the #SupremeCourt have one thing in common: the fight to erase minority communities' political power will continue.
In Dept of Commerce v NY, #SCOTUS kept the #citizenship question on #Census2020 barred, for now.

In Rucho v. Common Cause, SCOTUS threw up its hands and said it couldn't decide partisan gerrymandering cases - allowing the devious process to continue.
The Sec of Commerce (who heads @uscensusbureau) thought it was worth the risk to not count immigrants fearful of responding to a #censuscitizenship question.

The Court, of course, didn't think much of any of his stated justifications, finding them "contrived" and pretextual.

Supreme Court agrees with lower court decision in part about census citizenship question...The government explanation to put the question on the form was “INVALID”
The citizenship question can not stand as it was out now, giving the census bureau another chance to “rephrase” the Citizenship question, back to the 4th circuit court #CENSUS2020.

My non legal professor opinion, this will not make it to the 2020 census.
Basically: the citizenship question is blocked for now.
