BREAKING: Judge Furman DENIED motion for some @TheJusticeDept counsel to withdraw from the #2020Census case. cc: @CourthouseNews
The DOJ’s motion to withdraw certain attorneys is “patently insufficient,” Furman said in a scorching 3-page ruling.

Only two attorneys who left DOJ’s civil division, Brett Shumate and Alice LeCour, will be allowed to withdraw. Several others must stay.
Just as I noted last week, Furman pointed out in a footnote that SDNY counsel withdrew (successfully) earlier, and so this is the second DOJ withdrawal attempt.

Trump's citizenship question press conference has just started. whitehouse.gov/live/
TRUMP: "There used to be a time that you could declare you are a citizen of the United States."

As to declaring that on the decennial census, the last time you could do that was 1950.
Trump claims that the citizenship question helps provide a reliable count in the United States.

The Census Bureau disagrees, saying that it's cheaper and more effective to get that information from administrative records.

This is a key point:

1. Jeffrey Epstein's attorneys know they are proposing a type of bail package that the presiding judge passionately rejected three years ago, to enter a protracted battle over the previously held right of rich criminal defendants await out trial in luxury.
2. This is a key package:

"More precisely, we realize that Your Honor objects to the measure as more akin to custody than release, finding it inequitable for wealthier defendants to 'buy their way out' of jail pending trial."

The attorneys then signal Second Circuit battle.
3. Extremely wealthy defendants HAVE been able to finance luxe bail packages with armed guards keeping them under house arrest in their plush apartments.

Following in SDNY Judge Furman's footsteps, Maryland U.S. District Judge Hazel BLOCKS an attempt by @TheJusticeDept attorneys to withdraw from that #2020Census case.

There are subtle differences between the two rulings.

Unlike in SDNY, Hazel says that local rules in Maryland don't mandate that attorneys give "satisfactory reasons for withdrawal," and plaintiffs don't oppose there.

What both have in common, the judge added, is disruption.
The upshot here is the same as in SDNY:

Hazel ordered them to provide a fuller record on the transition and took steps to hold them accountable. A new legal team isn't a "clean slate for a party to proceed as if prior representations made to the Court were not in fact made."

Herein lies a problem, when MDL judges are given absolute authority. While the "administrative" rules absolutely alter the settlement and place the checks and balances in favor of the NFL, she finds it within her authority to do so.
This order in no way "protects" the class, and this is not an "enforcement of terms" but a re-write of terms without notice to the class or an ability to opt out as supposedly required by FRCP Rule 23 governing class action settlements.

Key holdings:

There was no good cause for defense counsel to withdraw (no proof of intrusion);

They were required to comply with the trial judge's orders despite their ethical objections; and

There's no absolute right to "learned counsel" in a capital military commission.
