The EHRC has been involved in producing Equality Act Guidance for Schools on Transitioning Pupils for some months. To date, this has been focused on England. /1
However, both the EHRC and the Scottish Government believe the guidance may be useful in Scotland, and so Scottish specific guidance has been produced. /2
These plans seem to be going on behind closed doors and the EHRC has only sought views from a few select orgs on how the guidance fits in the Scottish education landscape (they're seemingly satisfied the guidance appropriately reflects the requirements of the Equality Act!). /3

It's pretty poor guidance, with the all the usual concerns: doesn't address when/how single-sex exceptions can be upheld, UNCRC ignored, glossary is nonsense & schools are referred to Equality Network, Scottish Trans Alliance & Stonewall if help is needed with implementation. /5
The EHRC previously requested clarification from the UK Government regarding the use of single-sex exceptions:

More recently, the Women & Equalities Select Committee stated that non-statutory guidance will not bring clarity on Equality Act exceptions and that there needs to be statutory code approved by Parliament:

It seems strange then that the EHRC is forging ahead with more questionable guidance and that the Scottish Government may be seeking to use it to replace and/or override concerns about the recently withdrawn LGBT Youth guidance. /8
