Of all the things I've written on #Brexit, this is definitely the most quirky. 🏏

The 'night watchman' metaphor is to emphasise that the relevant parts of the #Protocol on NI/IRL need only kick in for any period when UK-EU conditions are sub-optimal.

It's an opinion piece primed for the #Ashes.

Co-authored with Bishop John McDowell, we argue the Protocol needs to be understood/designed as an interim arrangement that may or may not be called upon.

Allowing for this would avoid the mistake of risking all at this stage.

The purpose of the 'night watchman' in cricket is to avoid unnecessary losses and risks. Seems appropriate.

Somewhat unusually (for half an op ed), I dedicate this to my old English teacher, J.F.T.Gibbons from Newbury - a tremendous cricket fan & a sage & cherished friend.

@DPhinnemore We can all agree that consent = a good thing.
& when it comes to post-conflict NI, particularly so.
A history of mistrust & misuse of power means that making laws that work for people of all backgrounds = vital.
It's also important that democratic processes are seen to work.

@DPhinnemore There is no ‘principle’ of consent in #1998Agreement per se, but it's there in 2 main forms.

The 1st = majority consent.
No change to the constitutional status of NI without it being approved by the majority of people in NI. Hence the provision for a #borderpoll in future.

It certainly is if you are living in N.Ireland.

& most definitely is if you are a woman, gay or a victim of the Troubles.
(i.e. those whose rights were never properly met by the devolved assembly)

If the NI Executive is not restored by 21 Oct 2019, the UK Parliament has placed an obligation on the UK Govt to change the law in NI relating to 3 issues.

The Act requires that regulations are made in the following areas:
- same sex marriage
- abortion
- victims' pensions

To extend same sex marriage and opposite sex civil partnerships to Northern Ireland.

Marriage between couples of the same sex, and civil partnerships for opposite-sex couples, would be lawful in Northern Ireland from 13 January 2020.

[yes, this is currently illegal in NI]

If representation from N.Ireland in Westminister is unchanged (inc Sinn Fein abstention), this wd be a "grand committee" of DUP MPs.
With 1 exception.

Note: Indept. Sylvia Hermon was only MP from NI who attended Parl debate on the proposals on Thurs.

He says a review of the petition of concern could be "helpful" in addressing fears DUP wd have Stormont veto in post-Brexit decision.

You shouldn't really tweet when you're angry, so I'm going to have to be careful how I phrase this tweet, because at the moment I am very, very angry.

The Remain movement has within it the drive, imagination & purpose to come together & defeat Brexit.
Yet it seems incapable of doing so, for reasons I can't fully fathom. All Remainers are agreed on one thing - that Brexit is bad and should be stopped. For reasons known only to themselves, they can't agree on the best method of achieving this goal.
Everybody agrees on the destination - no fucker can agree on the route to be taken.
Do we dress up? Do we take a more sober approach? Do we sing songs? Do we put banners and advertising hoardings up in strategic places? Do we stand on College Green with a megaphone?

1) #Brexit - the really obvious stinger
Numerous bright & articulate anti no dealers come on telly and get attacked by brexit supporters (whether MPs, commentators or the public) for "blocking Brexit"

Why do they never shut this down with "but Brexit MPs voted to stop Brexit!"
2) the oversimplified view is "get #Brexit done"

The reality is - which brexit? Because brexiters can't decide on one

So May's deal was Brexit, it stopped free movement, it had the red lines

The ERG voted against it, they voted against Brexit
3) now as remainers we all know why the hard brexiters hate May's deal, and as a Remainer I hate it as well.

But the point is, it *was* Brexit, and the hard brexiters *did* vote against it, and if they hadn't, we'd have left by now

This morning, the QC for the Government's case will be submitting his skeleton argument (a summary which is supported by evidence, case law, affidavits etc in folders known as bundles). This afternoon, it's the turn of the QC representing the 78 Parliamentarians in Cherry case 2/
Yesterday, we heard from the teams that *lost* the cases that are being appealed to the Supreme Court. That's because in appeals, those doing the appeal go first. Pannick spoke for the Miller case, which lost in High Court; Keen argued for Govt which lost Scottish case. /3

Lots of talk about EU changing its position on #Brexit. Are they? Short thread
1. Consistency: “May’s” deal is outcome of *months* of negotiations - where both sides gave in. If UK wants to improve it, then UK must be one to table proposals - and these must respect SM & solve border. Y’day, @MichelBarnier said EU had not seen any.
2. Backstop: EU always said backstop wd only apply “unless and until” alternatives were found- but these alternatives don’t exit yet! So their view is backstop needs to stay.

If Johnson does renegotiate a deal, there isn't much time to pass it. He would need to get the Withdrawal Agreement Bill (to implement the deal in UK law) through Parliament before ratification. If conference recess is scheduled as normal, only 22 sitting days 3 Sept-31 Oct

If Johnson presses ahead with no deal then we know MPs will do all they can to stop it. Voting against principle of no deal -or disrupting govt legislative programme -cant stop it alone. MPs may try to pass leg forcing govt to act (either request A50 extension or revoke A50)

It is, I fear, time to address some legal questions surrounding the referendum - and say a couple of things none of the two #Brexit sides want to hear (thread)
The first one concerns the “annullment” of the referendum. Let’s suppose that electoral law would allow that - would that be effective?
You might remember that the referendum was advisory. That was one of the reasons that the Miller case held that parliamentary action was required to leave the EU. The referendum was not the legally relevant decision to leave the EU. Here’s a para. From the Miller judgment
