Good point here: reinforces what in any event should be the position - any MP in favour of a Withdrawal Agreement (eg @SKinnock) should refuse to vote for it until an extension is secured. That then allows proper time to debate the complex legislation required to implement it.
The idea that debate on this constitutionally critical and complex Bill should be cut short just to meet Johnson’s self-imposed deadline should be risible.
But as Jo says, voting for it before 19 October could also be walking into a trap, unless the SC has taken away Johnson’s power to prorogue in order to shut down Parliament.

Many reasons why it’s not good at all. But the narrow legal one is that the last 45 seconds of this extraordinary scene is - and I don’t say this sort of thing lightly - a straightforward and blatant lie by Johnson.
The Benn Act does not give the EU the power to decide how long the extension is. The House of Commons remains in control.
As to the rest of this vile and deeply shocking performance by Johnson, I cannot hope to improve on @stephenkb.

A reminder that, apart from the US, there are many other democracies with a Supreme Court charged with defending the constitution and human rights.
Try Ireland, for a start. Or Germany. Or France. Or, if you insist on crossing the Atlantic, Canada.
The ignorance of so many U.K. politicians of any foreign political system apart from the US is a really serious problem.

I don’t think @peston is right to say that the Supreme Court would be back in action. This is not a hard question of law: the Government can’t in a second letter try to undo the effect of the first. No court would construe the Benn Act as permitting that “clever” wheeze.
It would be a couple of hours in the High Court; prohibition or quashing order; permission to appeal refused. That is, if Johnson is still helplessly clinging on as PM by that point.
Basic rule of law: “clever” wheezes designed to get round what the statute clearly intended don’t work.

First a technical point: 25 working days are needed to organise a General Election

Count forward 25 working days from today... and you get 31 October. #Brexit day.

🚨 The UK now cannot hold a General Election before exit day 🚨
Of course there is the interim stage: that the Prime Minister has to go to the European Council and request a Brexit delay, something Johnson has said he will not do.

Holding an election until that extension is secured is dangerous.

Historians will have a hard time truly grasping what was going on in the UK when it made its way out of the EU. Just look how hard it is to follow at the moment and we are living through it, each story has several narratives, each quote 100 different perspectives. 1/
Let’s have a go at helping them in the most simplistic terms.

1. 2016 UK votes to leave the EU.
2. 2017 legislation to leave and notice is served to the EU March (2 year countdown starts).
3. 2017 UK elects minority government with 80%+ of MPs promising to leave the EU.

4. Negotiations go through their ups and downs, in 2018 (March) Tusk offers the UK the deal all leavers want (and the elected Parliament/government were trying to negotiate).
5. The PM tells the department she set up to work out a deal based on Tusks offer.

Taking a step back at the moment, after today it is hard to see how Boris Johnson can still legitimately claim to have "just the right amount of time" to agree _and_ ratify a #Brexit deal before October 31.

Here is a short thread looking at the timeline:

The first draft of the original Withdrawal Agreement was published on 28 February 2018.

The draft was finalised on 24 November 2018, after month of careful negotiations on the text.

The UK has not put forward alternative proposals for Northern Ireland yet. /2
In November 2018, the UK government lobbied the other EU27 countries for a special #EUCO to adopt the withdrawal agreement.

Main argument was that it could not wait until the December European Council, as the UK would need 4 month to get the WA through the Commons. /3

Right. #Brexit uncertainty abounds, but some things are pretty certain, and MPs' coming choices are now coming into sharp focus.

So take half a step back from Westminster fog, and perhaps it's not as quite as cloudy as it seems. Here's where we are #Brexit 1/Thread.
1. MPs can vote over May's divorce deal tomorrow. This is unlikely, I agree, but if they do, they have until May 22 to complete the paperwork.

If they do not back the deal, then the May 22 option is gone, per terms agreed with EU last week. /2
At which point, the UK is hurtling towards a 'no deal' - which MPs have rejected by 160-400 votes.

So assuming they don't want a 'no deal' what can they do?

They can activate second option, which is to ask the EU for a long extension. /3
