The debate over public goods is so confused because excludability and rivalry are functions of law, not goods themselves.

e.g. information and environment are public goods, yet consider IP laws and carbon-emission permits. Not my fav graphic but a start:

You can also take it to extremes. Is clean air non-excludable when you can buy air masks? Is the rule of law really non-rivalrous, when you can hire gangs to enforce it in your community? (This was a major jump for Nozick in ASU.)

I think we should try harder on these concepts.
