UPDATE on DOJ's ongoing attempt to carry out an execution on Monday — despite two stays of that first scheduled execution. This morning, DOJ filed a motion at the 7th Circuit to vacate the second stay of execution entered as to Daniel Lewis Lee. scribd.com/document/43859…
DOJ, in its motion, alerted the 7th Circuit that it "respectfully requests" a same-day ruling on the request to vacate a stay of execution — in other words, to allow DOJ to execute a man. And, yes, DOJ says it will go to #SCOTUS should the 7th Circuit deny its request.
This afternoon, Daniel Lewis Lee's lawyers filed their opposition to DOJ's motion: scribd.com/document/43859…
Here was my prior tweet about this second stay (which is part of a thread about the ongoing litigation, some of which is already pending, via a DOJ stay application in another case, at #SCOTUS):
Here is the full district court ruling, which DOJ is seeking to have vacated: scribd.com/document/43859…
WOW: This is unconscionable. DOJ is rushing to kill Daniel Lewis Lee — after delaying his litigation challenging the constitutionality of his sentence.

DOJ is doing so in the face of a federal judge who ruled that Lee presented "substantial grounds" for his claims. Dist ct:
Seriously, here's the district court motion: scribd.com/document/43860…

DOJ, in short: "Yes, we want to hurry up and kill this guy after not trying to do so for a long time, but we're also a little busy right now, so we'll get back to his constitutional claims when we have time."
BREAKING: The 7th Circuit has VACATED the Indiana district court's stay of execution against Daniel Lewis Lee. (This is only one of two stays that had been entered, meaning one remains — in a case in which DOJ has a request before #SCOTUS.) scribd.com/document/43860…
The panel was Easterbrook, Sykes, and Barrett.
BREAKING: FEDERAL EXECUTION WILL NOT GO FORWARD ON MONDAY. #SCOTUS denies DOJ request to lift district court stay of execution.
There were no noted dissents. Alito issued a statement, joined by Gorsuch and Kavanaugh, making clear that they think the challenge can and should be resolved quickly — but also suggesting they think DOJ was rushing (see highlighted). Full order: scribd.com/document/43860…
Here is a prior thread highlighting the arguments against DOJ, which was asking SCOTUS to allow it to proceed with executions while the men's challenge to DOJ's new execution protocol was ongoing.
Here is a statement from one of the men’s lawyers:
