It is annoying to see some people concoct excuses for the SSS despite the fact the SSS is yet to make a public statement on their naked, reckless and irresponsible actions at the Federal High Court in Abuja on Friday. /1

Why not wait for the SSS to tell us their usual fictional stories before you begin to masturbate in their defence?

Those talking about Sowore "breaching" his bail conditions are either ignorant or simply being mischievous. The SSS has no authority over Sowore's bail. /2

Let's assume that Sowore was seen in Lagos in defiance of his bail condition which has restricted him to Abuja, the SSS cannot arrest or detain him.

They can only go back to the court and complain by way of an application for the revocation of his bail. Sowore will be heard. /3

Only the court can determine whether a Defendant has violated the terms of his bail. Sowore's case file (I am not talking about the Court File) is no longer with the SSS. It is with the Attorney General who has engaged a private counsel, Liman SAN, to prosecute on his behalf. /4

The SSS deposed to an affidavit that they've concluded investigations.

The only business that the SSS has in this case as at today is for their officers who 'investigated' the case to testify in court for the prosecution whenever they are invited to do so. /5

Other than that, the SSS does not have any business with Justice Ojukwu's court in relation to Sowore and Bakare.

The proceedings of Friday was not slated for trial. The SSS had no business being in court. /6

Supposing there is a fresh charge against Sowore and Bakare or one of them, the sensible thing to do is to serve them with the new charge sheet and Arraignment Notice - which will indicate when they are to appear in court to take their plea on the new charge. /7

They are already standing trial and on bail and their movements have been restricted.

If they really wanted to arrest them, there are clear procedures under the law for effecting arrest in the circumstances. /8

They are entitled to be informed of the reason for their arrest. This was not done.

The SSS ought to present the warrant of arrest. No such warrant was presented.

The law expressly forbids arresting someone within the court. That is precisely what the SSS did on Friday. /9

As at this moment, we've not seen any new charge filed against Sowore or Bakare.

By the provisions of the Constitution, the SSS cannot detain anyone beyond 24 hours whether for investigation or preparatory to arraignment without an order of court. /10

This means that even if there is a new charge pending against Sowore, the SSS must arraign him by Monday.

I can confirm that as at Friday morning when we became aware of their nefarious plans, the SSS did not file any fresh charge. /11

If they later filed it before the close of work they have not brought it to our attention.

I can also confirm that no judge in Nigeria has set Monday or any date for the arraignment of Sowore or Bakare on any fresh charge. /12

So I ask the question: why did the SSS re-arrest Sowore in such brutal, violent and vile manner in the light of what I have stated above? /13
