This is the correct take. The original USMCA was strong on IP protections, but Trump admin caved to Nancy Pelosi and jettisoned demands that our trading partners respect and protect American biologics innovations. Extremely disappointed.
In this very unfortunate instance, the Trump administration's populist instincts to bash America's most globally competitive, innovative industry intersected with those of Nancy Pelosi's Democrats. The result is an awful, awful policy and it would be a terrible precedent.
I wrote an op/ed last year suggestion that USTR wasn't sufficiently committed to defending US IP in the USMCA negotiations. I got a call from the General Counsel of USTR reaming me out for questioning their commitment to IP. And now key IP provisions have been jettisoned.
