(Thread) Yet Another Smoking Gun🔫

Less than 2 hours after Trump’s call to Zelensky, Duffey (White House) told “David/Elaine/Lisa” to "please hold off any additional DoD obligations of these funds” in light of “the Administration's plan to review assistance to Ukraine. . . ”
1/ I’ve updated my new timeline. Scroll to the stuff highlighted in green⤵️

Here are the relevant parts of the sequence, updated:

On July 23: Morrison attended a meeting on whether Trump had the legal right to withhold the security aid.
2/ Morrison was aware that the DOD, in consultation with the State Department had already certified that Ukraine met the preconditions to release the aid. (Morrison’s deposition). assets.documentcloud.org/documents/6551…

Williams also attended this meeting. . .
3/ Williams said that among the topics of discussion was how to get Congress to remedy the hold on the security assistance, what legal recourse was appropriate, and how to get the funds paid by the end of the fiscal year.

4/ On July 25, 8:36:45 AM the morning of Trump's call to Zelensky, Kurt Volker told Zelensky's aide, Zermak, what Zelensky was expected to do:⤵️
5/ On July 25, at 11:04 AM (less than 2 hours after the call) Michael Duffey (White House Associate National Security Programs) sent the email we just learned about:
6/ Five hours after the call, Laura Cooper’s staff (Dept. of Defense) received a phone call from Ukrainians asking about the security assistance.

This is called circumstantial evidence.

The law doesn’t distinguish between direct and circumstantial evidence.
7/ Both are admissible and can be used to prove wrongdoing.

Usually there isn't direct evidence because most people don't commit crimes on camera or confess.

See my Nov. 21 NBC Op Ed:

8/ Circumstantial evidence requires making inferences.

If a person is holding a smoking gun, and another person is dead on the floor, we assume that the person with the gun shot the dead person — unless there's a compelling reason, backed up with facts, to believe otherwise.
9/ The evidence is compelling. The facts couldn’t be clearer.

Besides, Trump and his supporters don't deny the facts.

They say the evidence we have isn't enough to prove a crime.

Trump says what he did wasn't wrong.

Mulvaney said it's no big deal⤵️

10/ In a court of law, additional testimony (for example, Bolton or Mulvaney testifying) wouldn’t even be necessary.

The facts are clear enough.

But Schumer is doing this⤵️ to make crystal clear to the American people exactly what is going on.
11/ What’s going on is that any Republican Senators who line up with McConnell are enabling a disinformation and propaganda campaign.

What's happening is that a major political party is actively shielding a lawbreaking president.

The administration complied with a court order. See:

I don't see how the Friday before Christmas helps the administration. This gives people 2 weeks to stew on this.

People still read newspapers over the holidays.
