New thread - Why I assessed airline is at fault & should pay Kunal. Before that I'd like to clear - Kunal's behaviour was disruptive & definitely demands punishment as prescribed by various laws in force i.e CrPC, IPC, CAR & whatever applicable. My understanding is that 1/n
suo-moto cognisance can be taken by Airline crew/authorities in serious situation. In this case, victim (Arnab) has to file complaint (not done so far). My perception - since captain of flight (as available on SM) said he wasn't unruly/violent 2/n
bt he encroached personal space of Arnab, accosted him when 'seat belt sign was off'. I feel Indigo & Mr.Puri acted in haste in following instances - they immediately put a ban for 6 months aftr Mr.Puri's tweet in absence of complaint by Arnab/Captain 3/n 
and even before formal inquiry by committee into the incidence and their decision- some airlines were smart to use term "until further notice" instead of specifying duration of ban. Indigo might've been on safer side had it simply said, Kunal will be on "no fly list" 4/n
until completion of inquiry. DGCA chief also disagreed with ban (I'll search & quote PTI's tweet later). Incidence on 13/Jan/2020 where Captain threatened 2 lady passengers on demand of wheel chair - he was "only" de-roastered pending inquiry 5/n
Indigo can't act arbitrarily just bcz minister tweeted - as a passenger enters into contract with airline after paying fare. Also airline can't discriminate entry to passenger, selectively, without substantial cause even if it reserves right to entry. 6/n
Arnab & Kunal - both are private citizens & law applies to them equally (rights as well) as like all citizens of the country. Even Sadhvi Pragyasingh deserves action/punishment for delaying flight. Govt. can't discriminate & act arbitrarily & such action must by questioned 7/n
by alert & responsible citizenry bcz someday even we might face such injustice/unfair treatment. While we may outrage against Kunal for incidence - totally justified but that doesn't entail arbitrary treatment to him. He should offer apology, if Arnab files complaint 8/n
Also Kunal will certainly seize opportunity to claim damages for causing mental agony & defamation - who wouldn't want to cash-in for being unfairly treated? Courts in India follow procedure established by law & not due process of law (unlike many western countries) 9/n
which is unfortunate2a certain extent bcz many criminals go scot-free by misusing loopholes in laws. e.g Salman Khan & many white collar criminals. End.
